Has Anyone Dealt with EV Tax Credit Issues? Dealer Not Filing Forms… Should I Wait or Fight?

I posted earlier about my dealer not submitting the 15400 form to the IRS through their portal. It’s been 10 days since this issue started and it seems like the dealership doesn’t know what they’re doing.

I heard from them today that they tried submitting the VIN through the IRS’s portal, which they should’ve done last year. But they can only submit the sales date for 5 days before today, which makes sense since they were supposed to do it within 3 days of the sale. Can they still submit that now, or should I fight for them to pay me this year? I’m just frustrated that they can ignore IRS rules and there are no consequences, while we, the buyers, are the ones losing out on the tax incentive. They should have a system in place to handle this every time they sell an EV, like a checklist or something.

I called the IRS. I filed my taxes and the return got rejected. The IRS agent told me to send in a paper return with form 8936, form 8936 schedule A filled out, and proof of purchase with the VIN, date, and my name. She said I’d still get the $7,500 and not to worry. I’ll be mailing the return soon.

I’m starting to lean towards doing the same. I know it’ll take longer to get my refund, but it seems like the cleaner option haha. Was your VIN submitted by your dealer through the IRS portal?

This is usually the best advice. My wife is an accountant and talks to the IRS a lot, and honestly, the people there are always helpful. They can give accurate answers much faster than anything you’ll find on forums.

I noticed that post hasn’t been updated to say if the guy was able to resubmit the e-file successfully. But thanks for the link, it’s full of great info. I’ve already contacted the TAS to see if they can help me.

I hate lazy dealers too.

I’m dealing with the same thing. I’ve been working with my dealership’s general sales manager for around 10 days. He got back to me a couple of days ago with this:

“Good morning, I made contact with someone at the IRS this morning. They confirmed that the period for submitting sales reports closed in December, but they expect updates for the Energy Credit in the spring. They think this will reopen the period for unsubmitted sales reports for 2024. I’ve signed up for notifications so we can report your sale as soon as it’s possible.”

As much as I want to wait for the dealer to hear back from the IRS, I think I’m just going to go the paper route because it seems more reliable.

Same situation here. An aide to one of my senators is helping me work with the IRS now. Hopefully this leads to a positive result.
